5. Intellectual Property and Ownership

  • Template-Based Solutions: Clients receive usage rights but not exclusive ownership of template-based websites or apps.

6. Website and App Maintenance

  • Post-Launch Support: We provide 30 days of complimentary bug fixes and minor adjustments after website or app launch.

  • Ongoing Maintenance: Separate maintenance agreements are available for ongoing updates, security patches, and feature enhancements.

  • Client Responsibility: Clients are responsible for content updates unless covered under a separate content management agreement.

  • Platform Updates: Mobile apps may require updates due to operating system changes, which may incur additional costs.

7. Hosting, Domains, and Technical Requirements

  • Hosting: Clients are responsible for arranging their own web hosting unless we provide managed hosting services under a separate agreement.

  • Domains: Domain registration and renewal are the client's responsibility unless otherwise agreed.

  • SSL Certificates: We recommend SSL certificates for all websites and can assist with implementation.

  • Backups: While we may provide backup solutions, clients are ultimately responsible for their own data backup strategies.

8. Confidentiality and Data Protection

  • We treat all client-provided information, business ideas, and proprietary data with strict confidentiality.

  • Client data will never be shared with third parties except as required to fulfill agreed services or by law.

9. Payment Terms

  • Website and app development projects typically require milestone payments throughout the development process.

  • Failure to pay may result in suspension of development work or withholding of final deliverables.

  • Late payments may incur interest as set out in your agreement.

10. Limitation of Liability

  • We are not liable for damages or losses beyond the value of amounts paid by the client within the previous 6 months.

  • We are not responsible for indirect, incidental, or consequential losses, including loss of profit, revenue, or business opportunities.

  • We are not liable for website or app downtime due to hosting issues, third-party service failures, or factors beyond our control.

  • Mobile app store approval processes are beyond our control, and we cannot guarantee approval or timelines.

11. Warranties and Disclaimer

  • Our websites and apps are delivered "as is" and "as available."

  • We warrant that custom developments will substantially conform to agreed specifications at the time of delivery.

  • We do not warrant compatibility with future browser updates, operating system changes, or third-party service modifications.

  • We make no warranties about website or app performance on hosting environments we do not control.

12. Cancellation and Termination Rights

  • Either party may terminate services for convenience with appropriate written notice.
